No one appears on behalf of the State although the name of the Advocate General is appearing in the cause list. Petitioners are in custody in connection with Jalalgarh P.S. Case No. 77 of 2020 for the offence under sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act and 21(a)(b) of the Narcotic Drugs and Psychotropic Substances Act.

Learned counsel for the petitioners submits that petitioners have no criminal antecedent and they are in custody since 9.6.2020.

Learned counsel for the petitioner submits that in the

Patna High Court CR. MISC. No.31014 of 2020(2) dt.08-01-2021 2/2 instant case 6.5 liters of codeine syrup has been seized. It is alleged that codeine syrup is used as a substitute of liquor. Considering the fact that petitioners have no criminal antecedent and they have remained in custody for more than six months, the Court is inclined to grant bail to the petitioners, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S. Act, Purnea, in connection with Jalalgarh P.S. Case No. 77 of 2020 subject to the condition that petitioners shall deposit Rs. 50,000/- cash to the court below and the amount of Rs. 50,000/- deposited by the petitioners shall abide by final outcome of Jalalgarh P.S.
