JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 18-09-2023 Heard Mr. Bipin Bihari Singh, learned counsel appearing on behalf of the petitioner; Mr. Sanjay Kumar, learned AC to GP-23 for the State and Mr. Raj Nandan Prasad, learned counsel assisted by Mr. Vishesh Kumar Singh, learned counsel for the Accountant General, Bihar.

2. Learned counsel appearing on behalf of the State submits that the District Programme Officer (Establishment), Saran has communicated to the Accountant General, Bihar vide Letter No. 974 dated 28.08.2023 for fixation of pension of the petitioner along with the service book and pension papers.

3. This Court would have imposed heavy cost on the District Programme Officer (Establishment), Saran for

Patna High Court CWJC No.7494 of 2023 dt.18-09-2023 2/2 having harassed the petitioner, however, since he has now communicated the correct sanction letter along with service book of the petitioner, this Court finds that the Accountant General, Bihar must forthwith fix the pension of the petitioner and communicate the same to the Treasury Officer, Saran. The above exercise is directed to to be completed within a period of ten days from the date of communication of this order. The Treasury Officer, Saran is directed to forthwith credit the amount within the aforesaid period into the Bank Account of the petitioner.

4. In light of the above direction, the present writ petition is disposed of.

5. In case the petitioner finds it proper, he may also cooperate the concerned authority for expeditious redressal of his grievance.

6. In case of non-compliance of the order by any of the authorities, the petitioner is at liberty to take legal action against them in accordance with law.
