====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 15-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Khudaganj P.S. Case No. 138 of 2024 dated 02.11.2024 registered for the offences punishable under Sections 221 and 316(5) of the B.N.S., 2023.

3. As per the prosecution case, the P.D.S. shop of the petitioner has been suspended due to irregularity and blackmailing of food-grains committed by him. It is further alleged that the petitioner intentionally interrupted the 'National Food Safety Act', 2013 and he has not transferred the government property and also interrupted in performing the government works.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the informant had already collected the POS Machine and left food-grains and other articles from the petitioner on 04.04.2024 with the help of the police. It is further submitted that earlier similar nature of case i.e., Khudaganj P.. S. Case No. 33 of 2024 had also been lodged against the petitioner on 04.04.2024 which is not justified in the eyes of law. There is case and counter case between the parties. It is further submitted that the petitioner is aged about 73 years and he is suffering from various ailments. The petitioner has two criminal antecedents and one case he is on bail and in another case he is on police bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 05.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C. Court No. VII, Hilsa, Nalanda in connection with Khudaganj
