JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Earlier petitioner and others have preferred Cr.Misc.No. 44600 of 2018 for granting anticipatory bail, which was permitted to be withdrawn by learned counsel for the petitioners on instruction vide order dated 31.7.2018. Submission of learned counsel for the petitioner is that under misconception the earlier application was withdrawn and so far petitioner is concerned, he is agent of non-banking company and no specific allegation has been attributed against him.

Heard learned APP also, who has opposed the prayer for anticipatory bail stating that petitioner is named in the FIR and there is allegation of fraud against him to the informant and others and petitioner is said to be one of the the main accused in this case.

Patna High Court Cr.Misc. No.68889 of 2018(2) dt.12-12-2018 2/2 Having heard both sides and the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner.

However, petitioner is directed to surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
