2. The petitioner is seeking regular bail in connection with Azamnagar (Salmari) P.S. Case No. 08 of 2024 for the offences punishable under Sections 341, 323, 324, 325, 354(B), 379, 347, 307, 504, 506/34 of the Indian Penal Code.

3. As per allegation, when the informant was digging the soil, the accused persons came there and started abusing and assaulting him by means of talwar, lathi, iron rod and dabiya, due to which she sustained head injuries.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that there is a land dispute between the parties. There is case and counter case and the

Patna High Court CR. MISC. No.36778 of 2024(3) dt.05-07-2024 2/2 petitioner is a person of clean antecedent. The petitioner is under custody since 16.02.2024.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the injuries on the person of the informant are grievous in nature.

6. The allegation against the petitioner is that he inflicted iron rod on the head of the informant but sharp-cut injury was found, which does not corroborate the allegation.

7. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Azamnagar (Salmari) P.S. Case No. 08 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
