The petitioner seeks bail in Sakra P.S. Case No.82 of 2020 registered under Section 392 of the Indian Penal Code. The informant alleged that when he reached near canal, six miscreants came on motorcycles and intercepted the motorcycle of the informant. They snatched his motorcycle, mobile phone of Samsung company and cash of Rs.65,000/-. The informant identified Jhunjhun, Bambam and Vicky Jha and did not identify the remaining three as they had masked their face with turban.
The learned counsel for the petitioner submits that name of the petitioner surfaced in the case in the confessional statement of Md. Firoz who was also not named in the F.I.R. Police submitted chargesheet under Sections 395 and 412 of the
Patna High Court CR. MISC. No.31503 of 2020(2) dt.02-12-2020 2/2 I.P.C. but no looted article was recovered from the possession of the petitioner and petitioner is in jail since 20.04.2020. Petitioner has not been put on T.I.P. The petitioner has got no criminal antecedent.
Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Muzaffarpur in connection with Sakra P.S. Case No.82 of 2020.
