JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-12-2020 In view of the submission and the undertaking of the learned counsel for the petitioner, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 24.11.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.
Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Paroo P.S. Case No. 335 of 2019, registered under Section 394 of the Indian Penal Code.
The accusation is that while the informant Mundrika Kumar Bharti was in the way in the evening of

No.31699 of 2020(2) dt.03-12-2020 2/3 18.08.2019 and when he reached near village-Jagdishpur, at that time, three miscreants reached near him, boarding on black colour motorcycle, who were in the age group of 18 to 20 years and on the point of pistol, they snatched his motorcycle and mobile. It is alleged that in the dicky of motorcycle, the informant had kept his driving licence, PAN Card, Aadhar Card and other papers. At that time, miscreants caused him injury through knife.
Learned counsel appearing for the petitioner submits that, in fact, petitioner was apprehended in Saraiya P.S. Case No. 566 of 2019 registered under Section 392 of the Indian Penal Code and, thereafter, Police got managed to record his confessional statement showing his name in the present case and three other cases i.e. Paroo P.S. Case No. 336 of 2019, Paroo P.S. Case No. 228 of 2019 and Sariya P.S. Case No. 03 of 2018. Further submission is that the petitioner is on bail in all the three cases, as detailed in paragraph No.3. Further submission is that while the petitioner is in custody since 08.11.2019, but he had not been put on T.I.P. while informant has detailed the age of the culprits.
