JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Tisiouta P.S. Case No. 43 of 2018, dated 08.08.2018, instituted for the offences under Section 414 of the I.P.C. and Sections 30(a), 32(ii), 38(ii), 41(i) of the Bihar Prohibition and Excise Act, 2016.

Since the petitioner has been made an accused in similar nature of case earlier about which reference has been made in paragraph 3 of the this petition, I am not inclined to grant anticipatory bail to him.

The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

However, should the petitioner surrender before

Patna High Court Cr.Misc. No.66649 of 2018(2) dt.17-12-2018 2/2 the Court below within a period of four weeks and seek regular bail, the Court below shall consider the case on its own merits without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
