2. Petitioner seeks regular bail in connection with Bhagwan Bazar P.S. Case No. 468 of 2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per prosecution case, 23 litres illicit liquor was recovered from a motorcycle.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has falsely been implicated. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 01.03.2025.

5. Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.32703 of 2025(2) dt.18-07-2025 2/2 bail application of the petitioner and submits that petitioner has got two criminal antecedents out of which one is of similar nature.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 468 of 2024.
