The petitioner is languishing in custody since 09.02.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that the F.I.R., named accused persons including the petitioner and few unknown persons tried to get the nephew of the informant sitted on the Motorcycle forcefully but any how the victim got himself released and started fleeing away when Pawan Sah made indiscriminate firing causing serious injury to Janardan Sah who subsequently succumbed to injury.

It is submitted by learned counsel for the petitioner that specific overt act is only alleged against Pawan Sah. A statement has been made in paragraph no. 3 of the petition that the petitioner

Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Supaul, in connection with Marouna P.S. Case No. 08 of 2014.
