The petitioners seek pre-arrest bail in connection with Excise Case No.202 of 2018 arising out of Chewara P.S. Case No.32 of 2018 registered under Section 30(a)(d) of the Bihar Prohibition and Excise Act, 2016.

Considering the recovery of huge quantity of materials collected for the purpose of manufacturing wine as also in view of the provision prescribed under sub.section (2) of Section 76 of the Bihar Prohibition and Excise Act, 2016, I am not inclined to grant them pre-arrest bail.

The application for grant of pre-arrest bail is rejected. In case, the petitioners surrender and seek bail the

Patna High Court Cr.Misc. No.67287 of 2018(2) dt.18-12-2018 2/2 same shall be considered on its own merits without being prejudiced in any manner by this order.
