Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 29-08-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code, Allegedly, this petitioner misused the privilege of bail granted by this court vide order passed in Cr. Misc. no.3052/2016 and he left his attendance before the trial court despite a condition being fixed in the said bail order directing him to be present on each and every date during trial.

The main submissions advanced by Sri Prabhat Kumar Singh, the learned counsel appearing for the petitioner are that after granting bail, the petitioner went outside for his livelihood in other State and he has been languishing in jail since 14.12.2021 after his

Sri Murli Dhar, learned APP appearing for the State has opposed the prayer for bail.

Heard both sides and perused the impugned order. Though the petitioner has misused the privilege of bail but considering his custody period, a lenient approach can be taken in respect of the petitioner. Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 4th Addl. Sessions Judge, Bhojpur at Ara in Sessions trial no. 239/2015 arising out of Agianon Bazar P.S Case No. 50 of 2015 on further condition that the petitioner shall deposit Rs 5,000/- in Nazarat of civil court concerned which will be returned to him after concluding his trial, he will remain continue in attending each date and if he again misuses the privilege of bail then the said amount will be forfeited in favour of the State.
