====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 30-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Sasaram Nagar (Darigaon) P.S. Case No. 183 of 2022 lodged on 05.03.2022 under Section 364(A) of the Indian Penal Code.

3. As per the prosecution, the FIR has been lodged against five unknown accused persons against whom there is an allegation of kidnapping the informant's father.

4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and his name has been figured in this case by the confessional statement of the co-accused. Counsel submits that some accused persons have been apprehended who have kidnapped the informant's father. Counsel submits that in paragraph no. 43 of the case diary, apprehended

Patna High Court CR. MISC. No.36924 of 2024(3) dt.30-08-2024 2/2 persons did not take the name of the present petitioner. Counsel further submits that criminal antecedent of the petitioner is clean and he is in custody since 15.12.2023. Counsel also submits that except Aditya Kumar, other co-accused persons have been granted bail by the co-ordinate Bench of this Court vide order dated 05.07.2024 passed in Cr. Misc. No. 84520 of 2023 along with Cr. Misc. No. 11446 of 2024 respectively.

4. Learned A.P.P. for the State opposes the prayer for bail and submits that the name of the petitioner has not been figured in the list of the persons from whom alleged kidnapping has been made.

5. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Sasaram, in connection with Sasaram Nagar (Darigaon) P.S. Case No. 183 of 2022, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
