Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Excise Case No.5 of 2018, corresponding to P.R. 42 of 2018, registered for the offences punishable under Sections 30(a)/38 of the Bihar Prohibition and Excise Act. The petitioner has got criminal antecedent under Bihar Prohibition and Excise Act as per disclosure made in the supplementary affidavit. The present allegation is also under the Bihar Prohibition and Excise Act.

Hence, in my view, this is not a fit case for grant of

Patna High Court CR. MISC. No.42034 of 2021(2) dt.15-12-2021 2/2 anticipatory bail. Accordingly, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within two weeks, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
