Petitioners apprehend arrest in connection with Chandi P.S. Case No. 4 of 2019 registered for the offence punishable under sections 302/34 of the Indian Penal Code and section 8 of the POCSO Act.

Patna High Court CR. MISC. No.33723 of 2019(9) dt.25-10-2021 2/2 Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to previous enmity. As per allegations, occurrence took place on 07.01.2019 but no information was given to the police. It is further submitted that the deceased might have died due to some other reason, but for wreaking vengeance the present false case has been lodged implicating these petitioners.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, XII/ 1st Additional Sessions Judge, Bhojpur at Ara in connection with Chandi P.S. Case No. 4 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
