JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but in course of investigation, when further statement of informant was recorded, she fairly accepted this fact that she has not seen the alleged occurrence. The other witnesses also do not claim to have identified the assailants and, therefore, it appears that not a single prosecution witness claims himself to be an eye witness of the alleged occurrence.

Accordingly, petitioner is directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Gaya in connection with Barachatti P.S.Case No. 402 of 2013.
