The petitioners seek pre-arrest bail in connection with Kesariya P. S. Case No. 235 of 2018 registered under Sections 304 B and 201/34 of the Indian Penal Code.

Considering the allegation that the petitioners killed the niece of the informant within three years of her marriage for non-fulfillment of demand of dowry, I am not inclined to grant pre-arrest bail to petitioner nos. 1 and 2, the father-in-law and brother-in-law of the victim respectively. Their application for grant of pre-arrest bail is rejected.

No.64981 of 2018(2) dt.14-12-2018 2/2 However, considering that the status of petitioner no. 3 Reeta Devi in the house was the same as that of the deceased, in the event of arrest or surrender before the court below within six weeks from today, she is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, East Champaran, Motihari in Kesariya P. S. Case No. 235 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
