JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-06-2023 Heard Mr. Yogesh Chandra Verma, learned counsel for the petitioner as well as learned APP for the State. In this case, the petitioner is seeking regular bail in connection with Aurangabad Town P.S. Case No. 320 of 2020, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

The allegation against the petitioner is that he was friend of the son of the informant and he took money of Rs. 8 lacs from the informant at the pretext of treatment of his brother, but he didn't return the same.

The petitioner was granted anticipatory bail provisionally on his assurance to return the entire money, but due to financial scarcity, he could not stand to his words and

Patna High Court CR. MISC. No.32929 of 2023(2) dt.21-06-2023 2/2 having no option, he surrendered before the court below. He is under custody for a period of three months and is a person of clean antecedent.

It has been assured that petitioner would be able to return only Rs. 2 lacs within a period of two months from his release.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 320 of 2020, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

The petitioner shall return Rs. 2 lacs to the informant within two months of his release.
