Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are languishing in custody for the offences punishable under Sections 147/148/149/302/504/506 of the Indian Penal Code and Section 27 of the Arms Act. The petitioners were members of the unlawful assembly named in the FIR. Co-accused Dharmendra Rai has caused fire-arm injury to the mother of the informant as a result

Patna High Court CR. MISC. No.31211 of 2020(2) dt.10-12-2020 2/2 whereof she died. The petitioners are in custody since June, 2020. Investigation of the case is already complete. Considering the fact that there is no specific overt-act against the petitioners and the occurrence took place for land dispute, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bachhwara P.S. Case No.210 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

(c) The petitioners shall not leave the country without permission of the trial Court.
