2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 447, 427, 504, 506, 354(A), 307, 379, 385 of the Indian Penal Code and Section 27 of Arms Act.

3. As per prosecution case, the petitioner along with other co-accused persons are alleged to have assaulted the informant and demanded extortion from him. Other co-accused also fired by their pistol.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There is admitted land dispute between the parties due to which the

Allegation against the petitioner is that he only caught hold the hand of one Smita Devi. No specific overt-act of assaulting attributed to the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 1.1.2023. In pursuance to the direction of this court, a letter dt. 12.7.2023 has been received by which it appears that no injury report of injured persons are available on record.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bihar P.S. Case No. 926 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif.
