The petitioners seek pre-arrest bail in connection with Trial No.4247 of 2017 arising out of Govindganj (Malahi) P.S. Case No.146 of 2016 registered for the offence punishable under Sections 448, 354, 504, 506 read with 34 of the Indian Penal Code, 3 and 4 of the Prevention of Witch (Daain) Practices Act, 1999.
Considering the submission made by the learned counsel for the petitioners that pursuant to notice of appearance issued by the investigating officer under Section 41A of the Code of Criminal Procedure, the petitioners had appeared before
Patna High Court Cr.Misc. No.67691 of 2018(2) dt.18-12-2018 2/2 the police and had co-operated in investigation and were never arrested by the police, in the event of arrest or surrender in the court below within a period of six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, East Champaran at Motihari in connection with Trial No.4247 of 2017 arising out of Govindganj (Malahi) P.S. Case No.146 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
