Case No.22 of 2014 as accused No.6. He was arrested on 28.4.2014. B.P. No.284/14, filed in the court of 1st Additional Sessions Judge, Patna, was rejected on 16.7.2014. Hence, this application for bail before this Court.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner was named as 6th accused in the F.I.R. itself along with seven named persons and three unknown persons. It is, no doubt, true that the victim died of bullet injuries. Prima facie, it is, however, clear that no specific overt act was alleged against the petitioner. Further, charge-sheet has been filed and investigation completed. This Court has already granted
Patna High Court Cr.Misc. No.33905 of 2014 (5) dt.03-03-2015 2/2 bail to some of the accused. Therefore, the petition is allowed.
The petitioner is directed to be released on bail upon furnishing the bail-bonds of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of A.C.J.M., Patna City in connection with Fatuha P.S. Case No.22 of 2014, subject to the condition that the petitioner shall report to the concerned police station between 10:00 a.m. and 11:00 a.m. on 2nd Sunday of every month. If the petitioner fails to report to the police station for two consecutive terms, his bail bond shall stand cancelled.
