The petitioner seeks bail in a case registered under Sections 342, 323, 504, 307, 379, 427/34 of the Indian Penal Code.

The prosecution case in short is that while the informant's son went his Sasural for taking Bidagari of his wife, he was restrained. Thereafter, other persons went there, who were assaulted by the accused persons as a result of which, injury was sustained by the people from informant's side. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Patna High Court CR. MISC. No.30907 of 2019(2) dt.20-06-2019 2/2 already been submitted. Single iron rod blow is alleged to have been given. No repetition of blow is made. The nature of injury is said to be simple. No offence u/S 307 of the Indian Penal Code is made out.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Roshan Kumar, learned Judicial Magistrate-Ist Class, Banka in connection with Katoriya P.S. Case No. 32 of 2019.
