2. Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 379, 406, 420/34 and other allied sections of the Indian Penal Code and section 138 of the N.I. Act.

3. Petitioner issued cheque of Rs.3.20 lacs to the informant but the same got dishonoured due to paucity of fund in the bank account.

4. Learned counsel for the petitioner submits that the petitioner is ready to return the cheque amount to the informant in installments, subject to the outcome of the criminal criminal case pending in the court below.

5. Considering the submission of learned counsel for the petitioner, in the event of arrest/ surrender within a period of six weeks from today, let the petitioner, named above, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Court

P. C., on the following terms and conditions:- (i) At the time of furnishing bail bond Rs. 2,00,000/- (two lac) shall be deposited in the Nazarat of the concerned civil court and a receipt to this effect shall be filed by the petitioner in the court below.
