JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2015 The petitioner is languishing in custody since 04.02.2014 in a case registered for the offences punishable under Sections 365/34 of the I.P.C. Subsequently charge-sheet has been submitted under Section 302 of the I.P.C. It is alleged that husband of the informant went to the petitioner, Basdo Das and Moti Das for getting his rupees eight lacs back which was given for providing employment of Teacher and Supervisor of Anganbari and thereafter husband of the informant went traceless.
Subsequently on confession of the petitioner the dead body of the husband of the informant was recovered.
It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and confession was before the police. Considering the fact that on confession of the
Patna High Court Cr.Misc. No.33566 of 2014 (3) dt.27-01-2015 2/2 petitioner the dead body of the husband of the informant was recovered, this Court is not inclined to grant bail to the petitioner.
Accordingly the application is dismissed in connection with Masaurhi P.S. Case No. 50 of 2014, pending in the Court of learned Sub-Divisional Judicial Magistrate, Masaurhi, Patna.
Let the trial be expedited.
