None ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-01-2021 Heard learned counsel appearing on behalf of the petitioner. No one appears on behalf of the State although the name of the Advocate General appears in the cause list. The petitioner is in custody in connection with Bhabua P.S. Case No.94 of 2020 for the offence under Sections 341, 323, 324, 379, 504 and 506/34 of the Indian Penal Code and subsequently Sections 307 and 302 of the IPC were added. Learned counsel for the petitioner submits that there is allegation of assault by lathi against the petitioner. Learned counsel submits that the assault on the head of the deceased is assigned to other accused persons, the deceased received two injuries which are not attributable to the petitioner. Petitioner is in custody since 17.03.2020.

Patna High Court CR. MISC. No.30944 of 2020(2) dt.06-01-2021 2/2 Considering the totality of the fact situation, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 94 of 2020.
