JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Petitioners are languishing in custody since 04.04.2014 and 10.05.2014 in a case registered for the offences punishable under Section 395 of the I.P.C.

The name of the petitioners sprang up on confession of the co-accused.

It is submitted by learned counsel for the petitioners that there is no recovery from the petitioners nor the

Patna High Court Cr.Misc. No.33230 of 2014 (4) dt.22-01-2015 2/2 petitioners have been put on T.I.P. The statements to that effect have been made in the petitions.

Considering the fact that petitioners have not been put on T.I.P, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Katihar in connection with Rautara P.S. Case No. 19 of 2014. Since petitioner Md. Rahim has criminal antecedent, let learned Court below cancel the bail bonds of the petitioner Md. Rahim, if he gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
