In this case, the petitioner is challenging the order of cognizance dated 04.05.2011 passed by Judicial Magistrate, 2nd Class, Bettiah, West Champaran, in Complaint Case No. 1432-C of 2009 (Trial No. 1242 of 2014).

The court below after looking the material available on record has taken cognizance for the offence punishable under Section 138 of the Negotiable Instruments Act. This Court does not find any error in the order of cognizance, accordingly, this petition is dismissed.
