2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act 2016.

3. It is alleged that 97.545 liters of foreign liquor was recovered from behind the house of one Dahari Singh.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got one criminal antecedent which is not similar in nature .

5. Learned counsel for the State opposes the bail petition.

6. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge Saran at Chapra in connection with Isuapur Police Station Case No. 69 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
