JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2015 Petitioner is languishing in custody since 10.03.2014 in a case registered for the offences punishable under Sections 414 of the I.P.C and 25(1-b)A/26/35 of the Arms Act.

From the possession of the petitioner one motorcycle, one country made pistol and four live cartridges were recovered.

It is submitted by learned counsel for the petitioner that motorcycle has been released in favour of Akhilesh Pal. Hence no case under Section 414 of the I.P.C. is made out.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial

Patna High Court Cr.Misc. No.35937 of 2014 (3) dt.12-01-2015 2/2 Magistrate, Saharsa in connection with Basnahi P.S. Case No. 14 of 2014.

Since the petitioner has criminal antecedent, learned Court below will cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during the trial.
