The father of the victim made allegation that the petitioner and others kidnapped his minor daughter. It is submitted that from perusal of the first information report itself it appears that it is not a case of kidnapping rather the victim has herself left her house. The doctor has assessed the age of victim 16-18 years. The victim has already been recovered and she has made her statement under section 164 Cr.P.C. The victim did not complain about any ill treatment against the petitioner.

Considering the facts aforesaid and the fact that petitioner is in jail since 01.11.2013, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.34927 of 2014 (3) dt.21-01-2015 2/2 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Kiishanganj in Kochadhaman P.S. Case No. 221 of 2013.
