JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-12-2020 Heard Mr. Ashok Kumar Mishra, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Bithan P. S. Case No. 95 of 2019 dated 11.10.2019, instituted for the offences under Sections 394 and 302 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

The deceased was shot dead while being robbed of his belongings. The implication of the petitioner in the present case is on the basis of confessional statement of one Wakil Mukhiya, who is on inimical terms with the petitioner. There is no recovery of any incriminating

Patna High Court CR. MISC. No.31378 of 2020(2) dt.02-12-2020 2/2 substance from the possession of the petitioner and he is in custody since 06.03.2020.

The petitioner does not have any criminal antecedents as well.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Rosera, Samastipur, in connection with Bithan P. S. Case No. 95 of 2019. The petition stands allowed.
