The petitioner seeks bail in connection with Special Case No. 377 of 2020, arising out of Fulkaha P. S. Case No. 34 of 2020 dated 06.04.2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 188, 269 and 270 of the Indian Penal Code.

It appears from the F.I.R. that 36 litres of Nepali liquor was recovered from the possession of the petitioner.

Patna High Court CR. MISC. No.31393 of 2020(2) dt.02-12-2020 2/2 The petitioner is stated to be in custody since 07.04.2020 and is a person of clean antecedents. Regard being had to the period of custody of the petitioner and his being a person of clean antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge -cum - Special Judge, Araria, in connection with Special Case No. 377 of 2020, arising out of Fulkaha P. S. Case No. 34 of 2020.

The petition stands allowed.
