JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Petitioner is languishing in custody since 04.04.2014 in a case registered for the offences punishable under Sections 395, 412 of the I.P.C.

From the informant Rs. 14,00/- was robbed after causing superficial injuries. The name of the petitioner sprang up on confession of co-accused Saroj Kumar Singh and Awadhesh Kumar.

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner nor the petitioner has been put on test identification parade. A statement to that effect has been made in para 11 of the petition. It is further submitted that co-accused Awadhesh Kumar has been granted bail vide Cr. Misc. No. 32609 of 2006. Considering the fact that petitioner has not been put on test identification parade, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.29080 of 2014 (4) dt.10-02-2015 2/2 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Dinara(Bhanas) P.S. Case No. 152 of 2005.
