Petitioner is apprehending arrest in connection with Ara Nawada P.S. Case No. 649 of 2018 for the offence under sections 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that the petitioner was not named in the FIR.
It is alleged that the petitioner was involved in theft of motorcycle. The name of the petitioner surfaced on the confessional statement of co-accused Guddu Kumar. Considering the fact that the petitioner has no criminal antecedent and he was not named in the FIR and nothing was recovered from his possession, the Court is inclined to grant
