JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2015 The present application has been listed under the heading "To Be Mentioned" at the instance of learned counsel for the petitioners for modification of the order dated 09.01.2015. It is brought to the notice of the Court that the prayer for bail was allowed with regard to petitioner Jaggu Rai @ Jaddu Rai but it has wrongly been typed as rejected. The aforementioned two applications filed on behalf of the petitioners was heard in connection with Agam Kuan P.S. Case No. 205 of 2014 registered
Patna High Court Cr.Misc. No.33114 of 2014 (4) dt.20-01-2015 2/3 for the offences punishable under Sections 307, 498A, 323 and 120B/34 of the IPC whereas it is alleged that petitioners being the husband and father of the husband of the informant assaulted the informant and subsequently child of the informant was throttled by the husband of the informant namely Pramod Rai (petitioner of Cr. Misc. No. 34585 of 2014). Considering the fact that the specific accusation of assaulting the informant and throttling the child of the informant are against Pramod Rai, bail application of Pramod Rai was rejected whereas prayer for bail of petitioner Jaggu Rai @ Jaddu Rai was allowed but it appears that due to typographical error, in the order dated 09.01.2015, it was recorded that the prayer for bail of both the petitioners are rejected. This fact was verified from the progress register of Court Master where also it was recorded that only bail application of Pramod Rai was rejected.
Considering the same, order dated 09.01.2015 is modified to the extent that prayer for bail of Pramod Rai(petitioner of Cr. Misc. No. 34585 of 2014) is rejected whereas petitioner of Cr. Misc. No. 33114 of 2014, Jaggu Rai @ Jaddu Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of like amount each to the satisfaction
