The petitioner seeks bail in connection with Dhaka P.S. Case No. 561 of 2022 registered for the offence under Sections 409/34 of the Indian Penal Code.

As per the prosecution case, it is alleged that despite allotment of fund under the government scheme Mukhya Mantri Gramin Payjal Yojana, this petitioner along with other co-accused did not complete the work within the stipulated period.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.02.2023 and he has no criminal

Learned A.P.P. has vehemently opposed the prayer for bail.

Two similarly situated co-accused persons have been granted Anticipatory Bail by this court in Cr. Misc. No. 3755 of 2023 and Cr. Misc. No. 13163 of 2023 respectively. For the reasons mentioned in the aforementioned cases, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sikrahana at Dhaka, East Champaran/concerned Court below in connection with Dhaka P.S. Case No. 561 of 2022.
