====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 08-01-2021 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
Recovery of liquor is alleged from an Anganwari Centre. No one was there at the time of recovery. Hence, FIR was lodged against unknown. During investigation, name of the petitioner surfaced for the reason that the petitioner has got two identical criminal antecedent. Petitioner is in custody since 19.08.2020.
Considering the facts of this case, let the petitioner, above named, be released on bail, after framing of the charges so that the trial may not hamper, on furnishing bail bond of
Patna High Court CR. MISC. No.31214 of 2020(3) dt.08-01-2021 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kuchai Kote Police Station Case No. 20 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
(d) If the petitioner would be found involved in identical offence in future that would be a ground for cancellation of bail in this case also by the learned court below itself.
