The two petitioners aged about 78 years and 68 years are before this Court. They are apprehending arrest in connection with Naubatpur P.S. Case No. 221 of 2018 for the offence under sections 302, 120(B), 307, 34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioners submits that petitioners have no criminal antecedent.

In the entire prosecution case, there is absolutely no allegation of any overt act except they are present at the place of occurrence.

Considering the fact that petitioners have no

No.65757 of 2018(2) dt.13-12-2018 2/2 criminal antecedent and they are aged about 78 and 68 years respectively and they have not played any specific role in commission of crime except they are standing at the place of occurrence, the Court is inclined to grant bail, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Danapur, in connection with Naubatpur P.S. Case No. 221 of 2018 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
