JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Saraiya P.S. Case No. 639 of 2019 for the offenses under Sections 272, 273 IPC and 30(a) of the Bihar Prohibition and Excise Act.

In the instant case 618 liters of liquor was seized from Government Marketing Center situated Chhitri Bazar and Bahilwara Jawahar Chowk.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Nothing was recovered from the possession of the petitioner.

Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur in connection with Saraiya P.S. Case No. 639 of 2019, subject to deposit of Rs. 50,000/- cash and further subject to the conditions laid down under Section 438(2) Cr.P.C.

The deposit of cash of Rs. 50,000/- shall abide by the final outcome of the present criminal case.
