Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Beldaur P.S. Case No. 02 of 2022 corresponding to G.R. No. 03 of 2022 lodged under Sections 447, 506/34 of the I.P.C. as well as under Sections 25 (1-b)a, 26, 35 of the Arms Act. As per the prosecution case, the recovery of one loaded desi katta with 5 live cartridges were made from the conscious possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.01.2022. One criminal case is already pending of the similar nature against the present

Patna High Court CR. MISC. No.32530 of 2022(2) dt.17-09-2022 2/2 petitioner. He submits that he is on bail in the said case and charge has already been filed in this case.

Learned counsel for the State opposes the prayer for bail and submits that in the earlier case pending against him is also under Arms Act.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present but he shall renew his prayer for bail before the Trial Court after 4 months from today. Trial Court thereafter shall release him on bail, fulfilling his own conditions so that his appearance shall be secured during trial. (Dr. Anshuman, J.) ashishsingh/- U T
