JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-04-2015 Petitioner is languishing in custody since 04.02.2014 in a case registered for the offences punishable under Sections 366A/34 of the I.P.C.

Accusation is kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that investigation was kept pending against the petitioner. The petitioner was charge-sheeted on 30.05.2014. The thrust of accusation is against Raju who after being charge-sheeted convicted vide Sessions Trial No. 73 of 2012 but thereafter he has been granted bail by this Court vide Cr. Appeal No. 141 of 2014. Though the victim was subsequently killed and then Raju was again convicted, but he has been granted bail in the subsequent case also vide Cr. Appeal(DB) No. 271 of 2014.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 102 of 2011.

Let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for two consecutive occasions during trial.
