2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.

3. As per prosecution case, three four years ago, daughter of informant got married with this petitioner and thereafter she went to live at her matrimonial house. It is alleged that after some time of marriage, this petitioner started demanding dowry due to which an altercation took place between daughter of informant and this petitioner. It is further alleged that on 27.12.2023, after scuffling with this petitioner, daughter of informant committed suicide by hanging in anger

Patna High Court CR. MISC. No.35202 of 2024(5) dt.15-01-2025 2/3 and this petitioner, who happens to be husband of the deceased, instigated her for the same.

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case merely because he happens to be husband of the deceased. As a matter of fact, on the date of occurrence, the deceased was beating the four month old child which was objected by this petitioner and thereafter petitioner went out of the house for doing agricultural work and later on the petitioner came to know that his wife has committed suicide. It is further submitted that the petitioner has neither killed the deceased nor he has instigated the deceased to commit suicide. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. and there is specific accusation that upon his instigation, the deceased has committed suicide.

6. Considering the aforesaid facts and circumstances and nature of accusation, the prayer for grant of anticipatory bail
