JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.05.2014 in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, suspicion was raised against the petitioner on two counts. Firstly, it is stated that there was dispute between the petitioner and deceased on the point of payment of rent and secondly, deceased had illicit relation with the second wife of the petitioner and furthermore, one witness also claimed to have seen the petitioner along with the deceased near the place from where the dead body of the deceased was recovered. Except

Patna High Court Cr.Misc. No.33820 of 2014 (3) dt.19-01-2015 the aforesaid circumstances as well as criminal antecedent, there appears to be nothing against the petitioner and admittedly, after completion of investigation police has submitted charge sheet against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties particularly, keeping in mind that none has claimed to have seen the actual killing of the deceased, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S.
