JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 Petitioner seeks bail in connection with Sonpur P.S. Case No. 238 of 2018 registered for the offences punishable under Sections 376, 511, 504 and 379 of the Indian Penal Code. Prosecution story is that the petitioner entered inside the house of the informant and attempted to commit rape upon her and she was assaulted also.

Submission of learned counsel for the petitioner is that as a matter of fact wife of the petitioner has lodged a case against the informant and for that the present case has been lodged, which he has mentioned in paragraph-10 of the petition and he is in custody for two months and he is ready to abide by any condition that may be imposed on him.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.30899 of 2019(2) dt.23-05-2019 2/2 petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, in connection with Sonpur P.S.Case No. 238 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
