2. The present petition has been preferred for the following relief/s:

(i) for quashing the order dated 20.7.2016 passed in land acquisition case no. 133 of 2000 by the Learned District Magistrate, Aurangabad whereby and whereunder the petition for making payment of

Patna High Court CWJC No. 1670 of 2017(5) dt.17-11-2025 2/2 compensation for the land acquired in the year 2007 for irrigation after following due procedure in the light of the direction of this Hon'ble court in C.W.J.C. no 3163 of 2012 as well as in M.J.C. no. 3939 of 2012 has been rejected by giving observation to pursue the matter before the competent court holding it as out of this court's decision though in the identical matter arising out of the same writ petition the concerned authority has directed to make payment of compensation as per the Land Acquisition Act.

3. After some argument, learned counsel for the petitioner prays for withdrawal of the petition.

4. Accordingly, the writ petition is dismissed as withdrawn.
