2. The petitioner has preferred this application for grant of regular bail in connection with Dhamdaha P.S. Case No. 61 of 2024 dated 27.02.2024 registered for the offences punishable u/s 394 of the Indian Penal Code.

3. As per the prosecution case, on 27.02.2024 the informant along with others went HDFC Bank and suddenly three unknown miscreants loaded on motorcycle overtook the informant and others and stopped them. It is also alleged that miscreants looted Rs. 50,000/- from the informant and Rs. 2,30,000/- from others on the point of knife.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No. 35278 of 2024(2) dt.16-05-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R and the name of the petitioner has sprung up in the confessional statement of the co-accused Md. Zakid. It is further submitted that no T.I.P. has been conducted in this case. There is general and omnibus allegation against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.03.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the nature of allegation levelled against the petitioner and the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with Dhamdaha P.S. Case No. 61 of 2024.

7. The application stands allowed.
