JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Complaint Case No. 121 of 2018 for the offenses under Sections 323, 341, 498A and 504 IPC.

Learned counsel for the petitioner submits that the petitioner is husband of the complainant. It is alleged that the petitioner was involved in torture of his wife for non-fulfillment of demand of dowry. The petitioner is ready to keep his wife with full honour and dignity.

Considering the statements made in para-13 of the bail application and in order to promote normalcy in conjugal

Patna High Court CR. MISC. No.31125 of 2020(2) dt.19-01-2021 2/2 life, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st, Madhepura in connection with Complaint Case No. 121 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.

It is made clear that if the petitioner misbehaves, neglects or torture physically or mentally to the complainant, the court below shall be at liberty to cancel the bail bonds of the petitioner.
