====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-01-2022 Heard Shri Uday Kumar, learned counsel for the petitioners and Shri Bharat Lal, learned A.P.P. for the State through virtual court proceedings.
Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek regular bail in connection with Adapur P.S. Case No. 17 of 2021 instituted for the offences under Sections 395 and 120(B) of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are in custody since 21.01.2021 and charge-sheet has been submitted in this case.
The informant alleges that four unknown criminal looted 100 grams gold and 1.5 Kg. silver from him and the informant raised suspicion on Ashok Singh and Butta Sahni on the
Patna High Court CR. MISC. No.43358 of 2021(2) dt.12-01-2022 2/2 ground that they had come to his shop and were following him when he had left the shop along with the aforesaid gold and silver. Learned counsel for the petitioners submits that petitioners are not named in the FIR, based on the confessional statement of co-accused their name transpired and in the FIR suspicion is against Ashok Singh and Butta Sahni. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners and submits that petitioners have one criminal antecedent.
Considering the fact that the petitioners are in custody since 21.01.2021, charge-sheet has been submitted in this case and the FIR is against unknown and name of the petitioners transpired in the confessional statement of co-accused let the petitioners above named be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Adapur P.S. Case No. 17 of 2021, with condition that one of the bailors of petitioner no. 1 shall be his father and of petitioner no. 2 shall be his son-in-law Siya Ram Rai. (Satyavrat Verma, J) Kundan/- U T
