The petitioner seeks bail in a case registered under Sections 307, 323, 341, 354, 447, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
Prosecution case in short is that while the informant along with his wife was sitting at his door, the petitioner came there on motorcycle and having taken out pistol from his waist, caught the hair of the informant's wife and threatened of dire consequences if the case filed by her is not withdrawn. While the informant came to rescue her, he was also fired by the petitioner as a result of which, he sustained fire-arms injury. It has been submitted on behalf of the petitioner that there
Patna High Court CR. MISC. No.30952 of 2020(3) dt.08-01-2021 2/2 is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet/Prosecution report in this case has already been submitted. The petitioner is in custody since 2412-2019. The petitioner has been falsely implicated in the present case. There is no repetition of firing alleged against the petitioner. The petitioner has remained in custody for more than a year.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Rosera, Samastipur in connection with Bibhutipur/Vibhutipur P.S.
